Terms & Conditions

Createanet Standard Terms and Conditions (Information Only)

Please note: These terms are provided for informational purposes only. Specific terms will be outlined and agreed on an individual contract basis. The following should be considered as a general guide and do not constitute a binding contract.


1. Parties

Between:

  • Createanet, 33 Duchy gardens Paignton tq3 1ep  (“Createanet”)

  • The Customer (“Customer”)

These Terms outline the general expectations and responsibilities between Createanet and the Customer.


2. Services

Createanet agrees to provide, and the Customer agrees to receive, the services as described in the corresponding project scope or proposal document.


3. Commencement

The agreement commences upon confirmation of acceptance and receipt of the initial non-refundable deposit. Work will not begin until the deposit has cleared.


4. Payment Terms

  • A non-refundable deposit is due upon signing the agreement.

  • Remaining payments are due per agreed milestones or on final delivery.

  • Late payments may incur administration fees or interest at 4% above the Lloyds TSB Bank base rate.


5. Transfer and Hosting Termination

  • Transfer requests must be submitted in writing with one calendar month’s notice.

  • A transfer fee may apply (standard 2 hours @ £85+VAT/hour).

  • Hosting-only termination also requires one month’s notice but no transfer fee.


6. Customer Obligations

The Customer agrees:

  • All information provided is accurate and non-offensive.

  • They hold all rights to content submitted to Createanet.

  • To make payments on time.

  • Not to solicit Createanet staff or partners during the project or for 3 years afterward.


7. Domain Names

Domains managed by Createanet remain the Customer’s property, provided accounts are settled. Customers managing their own domains accept full responsibility for renewals.


8. Termination

Createanet may terminate with immediate effect if:

  • Material breach occurs and is not remedied within 30 days.

  • Payment is overdue.

  • The Customer enters insolvency or bankruptcy.


9. Consequences of Termination

  • Websites and associated services may be withheld until full payment is made.

  • Suspension or permanent takedown may occur for unpaid accounts.

  • Hosting and other services may cease entirely if termination conditions are met.


10. Indemnity and Limitation of Liability

  • The Customer indemnifies Createanet against any claims or liabilities arising from website content.

  • Createanet is not liable for delays outside its control or for indirect or consequential loss.

  • Maximum liability is limited to the total amount paid under the agreement.
